Acceptable Use Policy
"Company" shall refer to the management team of SpexHost, LLC and the SpexHost, LCC corporate staff body.
"Customer" shall refer to any person(s) who places an order on our website, pay for, access and/or use services from SpexHost, LLC. This includes but is not limited to accessing our servers or accessing our Customer Billing Area.
"Billing Section" or "Customer Support" shall refer to all contents at http://www.spexhost.com/billing/ and any correspondance between Company and Customer via electronic mail or telephone.
All clients are required to abide by our Acceptable Use Policy as per our Terms of Service Customer Agreement.
Account Responsibility
The account holder is ultimately responsible for the content and actions that are performed using their credentials.
Any illegal action performed by a trustee of a customer is still the customer's responsibility.
It is important that customers use a strong password on their account.
SpexHost, LLC will attempt to rectify account theft problems but it also the account holder's responsibility to keep their account secure from intrusion.
Copyright
Use of our services to infringe upon any copyright or trademark is prohibited.
This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work.
The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account.
If you believe that your copyright or trademark is being infringed upon, please contact our Abuse Department with the information required.
If the request is of a licensing issue, we may require further documentation.
Subjugation
All resellers, clients, users, and sub networks of the services, servers, and IP addresses provided by SpexHost, LLC are subject to this AUP and any attempted or actual violation of this AUP by any person or party on your behalf with or without your consent shall be a violation of this AUP by you.
Unacceptable Material on our Servers
Proxy Scripts / Anonymizers, Pirated Software / Warez, image, filedump, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, commercial audio streaming (more than one or two streams), locally hosted chat scripts, Escrow, High-Yield Interest Programs(HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers, Spam Scripts and any software deemed to be malicious in nature by SpexHost, LLC.
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):
Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
Zero Tolerance Spam Policy:
We take zero tolerance against the sending of unsolicited e-mail, bulk emailing, and spam.
"Safe lists" and "double opt-in" will be treated as spam.
Any user who sends out spam will have their account terminated without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers.
This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups.
No organization or entity listed in the ROKSO may be hosted on our servers.
Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
SpexHost, LLC reserves the right to charge the holder of the account used to send any unsolicited e-mail a cleanup fee.
This cost of the cleanup fee is entirely at the discretion of SpexHost, LLC, but shall not exceed $500 USD.
Seedbox Account Provisions
- Account may be used to download LEGAL content. Customer is responsible for all content on their account.
- Any DMCA or copyright infringement notices will result in immediate account suspension for a minimum period of 24 hours.
- Company will send a Policy Enforcement Notice as well as copies of DMCA requests or copyright infringement notices to Customer when a violation has occurred.
- Company will remove all instances of copyright material found if any copyright infringement or DMCA is received.
- You may not share your login information with other users without express written permission from company via our Billing Section.
- Failure to adhere to these provisions after a Policy Enforcement Notice has been issued will result in account termination without refund.
Shell Account Provisions
- You may only run the designated number of processes allocated within your package.
- Unless otherwise noted, each process may have at most one connection to IRC at any given time. Any additional connections to IRC shall count as additional background processes, thus subtracting from your total allocated background processes.
- Standard shell accounts may not run IRC daemon software, ShoutCast or Audio Streaming Software, or any scripts which listen on ports 80, 8080, or 81.
- You may not attempt to "snoop" on other users, run restricted/prohibited commands, look outside your home directory, or otherwise attempt to circumvent security measures put in place to protect our servers.
- You may not attempt to break-in to other accounts or alter, change, or modify anything outside your home directory. This shall be classified as attempting to compromise our network infrastructure.
- You may not run emech bots without written permission from SpexHost, LLC via our Customer Support department.
- You may not use any vhosts or IP addresses not listed on our website without prior permission from SpexHost, LLC via our Customer Support department.
- You may not bind to all IP addresses, or bind to the main address of the server. This includes vhosts on BNCs or Eggdrops.
- You may not connect to any IRC servers which houses denial of service bots or DCC bots.
- You may not use our shell servers to download materials via torrents.
- You may not use the web space provided on your shell to host commercial web sites.
- Any PHP scripts must have prior approval from SpexHost, LLC via our Customer Support department.
- If running an IRCd server, botnets and dcc or fileshare bots are prohibited, as is linking to a server which has these.
- Housing or running of denial of service bots or drones is prohibited.
- Running any software classified as malicious by SpexHost, LLC is prohibited.
- Attempting to disrupt networks or services is prohibited.
- Phishing schemes or scams are prohibited.
- You may not use our service to evade bans, ignores, k-lines, g-lines, or any other network bans.
- You may not use our service to violate any other entity's acceptable use policy or break any laws.
- Our servers are subject to United States and International Law. All actions performed herein under your credentials are your actions and will be reported as so to authorities if required.
Web Hosting Account Provisions
- You may not host anything which interfaces with IRC without permission from SpexHost, LLC via our Customer Support department.
Revisions and Amendments
SpexHost, LLC reserves the right to modify, change, remove, alter, or add any clauses to this Acceptable Use Policy at any time without prior notification.
SpexHost, LLC will make an effort to notify customers of any substantial changes to our policies prior to them being in effect.
Customers shall be in agreement and subject to this Acceptable Use Policy at the time of modification by SpexHost, LLC.
